These Terms of Service (“Terms”) govern your use of www.cubbs.co.za (the “Website”) and any order you place with Cubbs Foods (Pty) Ltd (“Cubbs Foods”, “we”, “us”, or “our”). Please read them carefully. By using the Website or placing an order, you agree to these Terms.
1. About us
Cubbs Foods is a South African food manufacturer registered in the Republic of South Africa. Our trading and contact details are:

2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order on this website. By placing an order you warrant that the information you provide is true, accurate, and complete.
3. Products and pricing
3.1 We sell dip mixes and salad-dressing sachets, supplied in boxes of 12 sachets per flavour (“box”). Product descriptions, weights, ingredients, and serving instructions are shown on each product page.
3.2 All prices on the Website are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at 15%, unless expressly stated otherwise. Delivery is charged separately and shown at checkout.
3.3 While we take care to display accurate prices, errors do occur. If a pricing error is discovered after you place an order, we will contact you before processing payment. You may then confirm or cancel the order.
3.4 Prices, availability, and the product range may change at any time without prior notice.
4. Placing an order
4.1 Adding a product to your cart and submitting the checkout form constitutes an offer to purchase. No contract is formed until we contact you to confirm the order.
4.2 We reserve the right to refuse or cancel any order at our discretion, including (but not limited to) cases of suspected fraud, where stock is unavailable, or where the delivery address is outside the area we can reasonably deliver to.
4.3 Once you place an order, we will contact you by phone or email within 24 working hours to confirm the order and provide our banking details.
5. Payment
5.1 Payment is made by electronic funds transfer (EFT) to our bank account. We do not currently accept credit or debit card payments online.
5.2 You must use the order reference we provide (for example, #10204) as the EFT payment reference.
5.3 Title in (ownership of) the goods passes to you only once payment has been received in full and the goods have been dispatched. Risk in the goods passes to you upon delivery.
6. Delivery
6.1 We deliver via Postnet to Postnet, anywhere in Southern Africa, at a flat rate of R109 per order for up to six (6) boxes (i.e. 72 sachets). Orders of R1,000 or more qualify for free delivery.
6.2 Estimated dispatch time is 2 working days from receipt of payment. Delivery time thereafter is determined by Postnet and is typically 2-5 working days.
6.3 Delivery dates and times are indicative only and not guaranteed. We are not liable for delays caused by Postnet, courier interruptions, public holidays, or events outside our reasonable control.
6.4 It is your responsibility to provide an accurate Postnet collection point or delivery address. Re-delivery as a result of incorrect address information may incur an additional fee.
7. Cooling-off period and cancellations (Consumer Protection Act)
7.1 In line with the Consumer Protection Act, 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act, 25 of 2002 (“ECTA”), you may cancel an electronic transaction within seven (7) days of receiving the goods, without reason and without penalty, by emailing info@cubbs.co.za with your order number.
7.2 To exercise this right, the goods must be unopened, unused, and in their original packaging. You must arrange return delivery at your own cost. Once we receive the goods in resalable condition, we will refund the purchase price (excluding original delivery charges) within 30 days, in line with §44 of the ECTA.
7.3 If goods are damaged, defective, or not as described, please contact us within 7 days of receipt. We will, at your option, replace the goods, repair them, or refund them in full (including delivery), in line with §55–§56 of the CPA. We will arrange and pay for return transport in these cases.
8. Customer responsibilities
8.1 You agree to provide accurate ordering and delivery information.
8.2 You agree not to use the Website in any unlawful way, including (but not limited to) attempting to gain unauthorised access, scraping the Website at unreasonable volume, or interfering with its operation.
8.3 You agree not to introduce viruses, trojans, or other malicious code through the Website.
9. Intellectual property
9.1 All content on the Website — including the Cubbs Foods name, logo, product names, packaging artwork, photography, recipes, text, and code — is owned by or licensed to Cubbs Foods (Pty) Ltd and is protected by South African and international copyright and trade-mark law.
9.2 You may not copy, reproduce, distribute, or commercially exploit any content from the Website without our prior written consent. Personal, non-commercial sharing of recipe pages is permitted.
10. Limitation of liability
10.1 Nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under South African law (including under the CPA).
10.2 Subject to clause 10.1, our total liability to you in connection with any order or use of the Website is limited to the total amount paid by you for that order.
10.3 We are not liable for any indirect, consequential, special, or incidental loss (including loss of profit, business, or goodwill) arising from your use of our products or the Website.
11. Allergens and product information
11.1 We list known allergens on each product page and pack in line with the Foodstuffs, Cosmetics and Disinfectants Act and applicable regulations.
11.2 If you have a serious allergy or specific dietary requirement, please contact us before ordering. Our manufacturing facility handles wheat, milk, egg, soya, and gluten among other ingredients; while we take care to prevent cross-contamination, traces may be present.
11.3 You are responsible for reading the ingredients and allergen statement on each pack before consumption.
12. Force majeure
We are not liable for any failure or delay in performance caused by events outside our reasonable control, including natural disasters, civil disturbance, government action, load-shedding, courier strikes, or pandemics.
13. Privacy
Your personal information is processed in line with our Privacy Policy, which forms part of these Terms.
14. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page and is dated above. Continued use of the Website after a change means you accept the updated Terms.
15. Severability
If any clause of these Terms is found to be unlawful, void, or unenforceable, the remaining clauses continue in full force and effect.
16. Governing law and jurisdiction
These Terms and any order made through the Website are governed by the laws of the Republic of South Africa. You and we both consent to the jurisdiction of the South African courts in any dispute arising from these Terms.
